Terms & Conditions

Effective 1 September 2026

These Terms & Conditions apply to goods and services supplied by Ethos Air Pty Ltd ABN 85 699 586 742 (“Ethos Air”, “we”, “us”).

They should be read together with the relevant quotation, proposal, work order, maintenance agreement or other contract issued by Ethos Air. If there is an inconsistency, the job-specific document will apply to the extent of that inconsistency.

01 Quotations and acceptance

Unless otherwise stated, quotations are valid for 30 days and are based on the information and site conditions known to us at the time.

A contract may be formed when you accept our quotation or proposal, instruct us to proceed, pay a requested deposit or otherwise authorise us to commence work.

Changes to the agreed scope, site conditions or customer requirements may result in additional charges. We will seek approval before carrying out material additional work wherever reasonably practicable.

02 Pricing and payment

Prices and payment terms will be set out in the quotation or proposal.

Deposits may be required before equipment is ordered or work is scheduled.

Invoices must be paid by the due date shown on the invoice. We may suspend further work or supply where an account is overdue.

Reasonable costs incurred in recovering overdue amounts may be charged to the Customer to the extent permitted by law.

03 Cancellation and rescheduling

If you cancel or postpone work after accepting a quotation, you may be responsible for reasonable costs already incurred by Ethos Air, including:

  • equipment or materials already ordered;
  • supplier cancellation or restocking charges;
  • non-returnable or specially ordered goods; and
  • labour or other costs reasonably committed to the work.

Any refund will take into account costs reasonably incurred before cancellation and any rights you may have under applicable law.

If work is delayed because of site access, customer instructions, third-party works, weather, supply delays or circumstances outside our reasonable control, the work may need to be rescheduled and reasonable additional costs may apply.

04 Site access and customer responsibilities

The Customer must provide reasonable and safe access to the site and equipment and advise Ethos Air of any known hazards, access restrictions or site requirements.

Unless included in our quotation, work by other trades, building works, structural modifications, electrical upgrades, access equipment, approvals and other third-party services are not included.

Any specific exclusions or customer responsibilities will be identified in the quotation where relevant.

05 Service, diagnostics and repairs

Diagnostic and repair work is undertaken using reasonable care and skill based on the condition of the equipment and information available at the time.

Some faults cannot be fully identified until diagnostic or repair work has commenced. Additional faults or required works may therefore become apparent during the service.

Where additional work is required, Ethos Air will explain the issue and obtain approval before proceeding where reasonably practicable.

Diagnostic or attendance charges remain payable for work undertaken even if the Customer decides not to proceed with a recommended repair.

Preventative maintenance reduces the risk of breakdown but does not guarantee uninterrupted operation or prevent every future fault.

Any warranty applying to repair or service work will be as stated in the relevant quotation, work order or invoice and does not constitute a warranty over the complete system.

06 Equipment, parts and warranties

Manufacturer warranties apply to equipment and parts in accordance with the manufacturer's applicable warranty terms.

New air conditioning systems installed by Ethos Air are covered by a five (5) year workmanship warranty from the date of commissioning, unless otherwise stated in the quotation or contract.

The Ethos Air workmanship warranty applies to faults arising from the installation work performed by Ethos Air. It is separate from, and does not replace, any manufacturer warranty applying to equipment or components.

Customers with an eligible Ethos Care planned maintenance agreement may receive extended workmanship warranty cover beyond the standard five-year period while the agreement remains current, subject to the applicable Ethos Care terms.

Warranty coverage does not apply to faults or damage caused or contributed to by circumstances outside Ethos Air's workmanship, including:

  • Misuse, accidental damage or operator error
  • Alterations, repairs or modifications carried out by others
  • External electrical, building or site-related issues
  • Failure of equipment or components covered by a manufacturer or supplier warranty
  • Inadequate or unreasonable lack of maintenance
  • Normal wear and tear or consumable items
  • Events or conditions outside Ethos Air's reasonable control

Where a warranty concern is reported, Ethos Air may inspect or diagnose the system to determine the cause of the issue. If the issue is not covered by an applicable warranty, reasonable attendance, diagnostic, labour, parts or other costs may apply.

Our warranties are in addition to, and do not limit, any rights or remedies available under the Australian Consumer Law or other applicable legislation.

07 Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Where permitted by law, liability relating to goods or services not ordinarily acquired for personal, domestic or household use may be limited to the remedies permitted by the Australian Consumer Law.

08 Liability

To the extent permitted by law, Ethos Air is not liable for indirect or consequential loss arising from equipment failure, delays or circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where it cannot lawfully be excluded or limited.

09 Privacy

We handle personal information in accordance with our Privacy Policy.

We may use information provided by you for quotation, scheduling, service delivery, invoicing, customer communication and other purposes reasonably connected with providing our services.

10 Disputes

If a concern or dispute arises, please contact Ethos Air so we can attempt to resolve it promptly and in good faith.

If the matter cannot be resolved directly, either party may pursue any rights or dispute-resolution process available under applicable law.

11 Governing law

These Terms & Conditions are governed by the laws of New South Wales, Australia.
